Terms and Conditions
1. Conditions of participation
1.1 Dog liability insurance. Participation requires valid dog owner liability insurance (also covering activities supervised by a trainer) as well as registration of the dog with the authorities. Proof must be produced on request.
1.2 Health and vaccination. Only dogs that are healthy, free of parasites and up to date with current vaccination recommendations may take part.
1.3 Duty to disclose. Known illnesses, pain, allergies and behavioural particularities (aggression, severe anxiety or predatory behaviour, for example) must be disclosed before the first session.
1.4 Dogs in season. Dogs in season may only take part with the trainer's prior agreement; for some group activities, participation may be postponed.
1.5 Minors. Minors may only take part when accompanied by an adult with parental responsibility.
1.6 Equipment and cooperation. For activities that come with an equipment list (paddleboarding and kayaking, hikes, winter outings, for example), the safety equipment stated in the booking confirmation must be brought without fail. For water activities the rule admits no exception: all participants and all dogs wear a suitable, correctly sized buoyancy aid for the entire duration of the activity. Epic Dog reserves the right to exclude from the activity anyone whose equipment is insufficient, faulty or dangerous, with no right to a refund, as this failing falls within the participant's responsibility.
1.7 Declaration of fitness and health. By booking, participants firmly confirm that they and their dog are equal to the physical and mental demands of the activity concerned.
2. Formation of contract, cancellation and postponement
2.1 Subject of the contract. Epic Dog offers individual coaching, group activities (Social Walks, dog sports, for example), adventures and experiential offerings for dogs and their humans. No specific learning outcome is guaranteed; it depends essentially on the participant's own involvement.
2.1a Scope for outdoor and water activities. Epic Dog is not a certified provider of water sports or mountain sports instruction and gives no technical tuition in stand-up paddleboarding (SUP), kayaking or canoeing. The adventure offerings cover exclusively the dog-related support and the work of the human-dog team during the activity (habituating the dog to the board or the boat, safety and communication within the team). The sporting practice itself remains the participant's own responsibility.
2.2 Formation of the contract. The contract is formed by the booking confirmation, online through the booking system, by email or verbally.
2.3 Cancellation by the participant. Individual sessions and coaching: free cancellation up to 48 hours before the appointment. In case of later cancellation or non-attendance, the full amount remains payable, unless the slot can be given to someone else. Group activities and adventures: cancellation up to 48 hours before, subject to an administration fee of 30%; in case of later cancellation, the full amount remains payable. Amounts already paid online are refunded or offset accordingly.
2.4 Cancellation, modification and interruption by Epic Dog. Epic Dog may cancel an activity if the minimum number of participants is not reached or in exceptional circumstances (illness, force majeure, for example); amounts already paid are refunded or credited. Epic Dog further reserves the right to change the programme, route or location of an activity at short notice, or to interrupt it, where safety requires (change of weather, thunderstorm, high winds, water levels, for example). If an activity is cancelled before it starts for safety reasons, participants receive a refund or a credit. If an activity in progress has to be interrupted for safety reasons, no claim arises for reimbursement of services already provided or for compensation of expenses incurred in vain (travel costs, for example).
3. Prices and payment
3.1 Prices. The applicable prices are those currently published on epicdog.eu.
3.2 Payment terms. Depending on the offering, payment is made online at the time of booking (payment provider Stripe), by bank transfer, or in cash after the service. The invoice is sent by email.
3.3 Small business scheme. In accordance with § 19 UStG, no VAT is charged or shown.
3.4 Cards and packages. Multi-session cards (a 5-session card, for example) are valid for 3 years from purchase. Cards are not transferable and are not refunded pro rata.
4. Liability
4.1 Epic Dog's liability. Epic Dog is liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. In cases of slight negligence, Epic Dog is liable only for breach of essential contractual obligations, and limited to the foreseeable damage typical of this type of contract.
4.2 Animal keeper's liability. The strict liability of animal keepers (§ 833 BGB) remains unaffected. Participants are liable for all damage caused by their dog to people, to other dogs, to equipment or to the environment, and indemnify Epic Dog against third-party claims on that basis.
4.3 Natural risks. Activities in the outdoors carry residual risks inherent to that setting, which even the greatest care cannot entirely exclude (uneven ground, wild animals, sudden changes of weather, currents, for example). Epic Dog is not liable for damage resulting from such unforeseeable natural risks inherent to the activity, except in the case of culpable conduct on its part.
5. Rules during the activity
5.1 Trainer's authority. The trainer has authority to give directions for the entire duration of the activity.
5.2 Exclusion for disruption. In cases of significant disruption or dangerous behaviour (human or dog), participants may be excluded from the activity without refund.
5.3 Alcohol and drugs. Participation under the influence of alcohol or drugs is not permitted.
5.4 Photos and videos. Photographs and video taken by Epic Dog are made only on the basis of separate consent (photo and video release). Without that consent, participants are not published in recognisable form.
6. Final provisions
6.1 Severability. Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
6.2 Amendments. Amendments and additions require written form.
6.3 Governing law. German law applies.
6.4 Authoritative language. This English version is provided for your convenience only and is not legally binding. In the event of any discrepancy in interpretation, the German version alone is authoritative.
Right of withdrawal
Note on leisure activities with a fixed date: for services connected with leisure activities scheduled for a specific date or period (coaching appointments, classes, Social Walks, adventure days, for example), there is no statutory right of withdrawal, in accordance with § 312g(2) no. 9 BGB. The cancellation terms of these Terms and Conditions apply instead (point 2.3).
For offerings without a fixed date (online courses, for example):
You have 14 days to withdraw from this contract without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise this right, you must inform us:
Laure Amadeï, Epic Dog, Pfauenstraße 8A, 79426 Buggingen, email: info@epicdog.eu
of your decision to withdraw by means of an unambiguous statement (by email, for example). To meet the deadline, it is sufficient that you send your communication before the period expires.
Effects of withdrawal: if you withdraw, we refund all payments received without delay, and at the latest within 14 days of receiving your statement, using the same means of payment. If you asked for the service to begin during the withdrawal period, you pay us an amount proportionate to the services already provided up to your withdrawal.
